These Terms and Conditions ("Terms") govern your use of the services provided by Forte & S LLC DBA Locust Mowers ("we," "us," or "our"), including our website, in-store services, and any related communications. By using our services, you agree to be bound by these Terms.
1. Services Provided
We provide machinery and equipment repair and maintenance services. We will diagnose the issue with your machinery or equipment and provide you with an estimate for the service or repair. We will only perform the service or repair if you approve the estimate.
2. Estimates and Payment
Estimates are provided based on our initial assessment of the machinery or equipment. The actual cost of the service or repair may vary if additional issues are discovered during the process. We will notify you of any changes to the estimate and obtain your approval before proceeding. Approval can be provided in writing or verbally.
Payment is due upon completion of the service or repair. A diagnostic fee may be charged if you decline the service or repair after we have diagnosed the issue. This fee covers the time and expertise involved in diagnosing the problem.
3. Data Loss
Important: You are solely responsible for backing up any operational data, settings, or stored information related to your machinery or equipment before bringing it in for service or repair. We are not responsible for any data loss that may occur during the service or repair process.
While we take precautions, we cannot guarantee that data, settings, or configurations associated with your machinery or equipment will not be lost or altered.
4. Warranty
We offer different types of warranties based on the services performed. The warranty covers defects in workmanship and parts used in the service or repair for the applicable warranty period, which varies depending on the type of service provided.
The warranty does not cover accidental damage, misuse, improper operation, liquid damage, or unauthorized modifications to the machinery or equipment.
The warranty is void if the machinery or equipment is opened, altered, or tampered with by anyone other than us.
To claim warranty service, you must return the machinery or equipment to us with proof of purchase.
5. Limitation of Liability
To the fullest extent permitted by applicable law, our liability for any damages arising out of or relating to our services is limited to the amount you paid for the service or repair.
We are not liable for any indirect, incidental, consequential, or punitive damages, including but not limited to lost profits, lost data, downtime, or loss of use of your machinery or equipment.
Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
6. Abandoned Machinery or Equipment
If you fail to pick up your serviced or repaired machinery or equipment within 90 days after we notify you that it is ready, it may be considered abandoned. We will attempt to contact you via phone and email before considering machinery or equipment abandoned.
We will make reasonable efforts to contact you before disposing of abandoned machinery or equipment.
We may sell or otherwise dispose of abandoned machinery or equipment to recoup our costs.
7. SMS/Text Messaging
We use SMS/text messaging through our point-of-sale (POS) system to communicate with you regarding appointment reminders, service or repair updates, and, with your express consent, occasional promotional offers relevant to your machinery or service history.
Consent:
By providing your mobile phone number and opting in to receive SMS messages from us, you consent to receive text messages from Forte & S LLC DBA Locust Mowers for the specified purposes. You may provide consent verbally.
Opt-Out:
You can opt out of receiving SMS messages at any time by replying “STOP” to any message you receive from us. Doing so will remove you from all SMS campaigns managed through our POS provider.
Message Frequency:
Message frequency varies. You will primarily receive messages related to scheduled appointments and updates on the status of your machinery or equipment service or repair. Promotional messages are sent sparingly and only to customers who have explicitly opted in.

10DLC Compliance:
We are committed to complying with all applicable 10DLC (10-Digit Long Code) regulations and guidelines through our SMS services.
Permitted Message Types:
We only send the following types of SMS messages:
Appointment reminders for scheduled service visits
Service or repair updates (e.g., diagnostics complete, parts ordered, service completed)
Missed call notifications
Review requests following completion of a service or repair
No Sharing of Information:
We will not share your mobile phone number with any third parties for their own marketing purposes.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles.
9. Dispute Resolution
Any dispute arising out of or relating to these Terms shall be resolved in accordance with applicable regulations in the State of North Carolina.
10. Entire Agreement
These Terms constitute the entire agreement between you and us relating to our services and supersede all prior or contemporaneous communications and proposals, whether oral or written.
11. Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall remain in full force and effect.
12. Changes to These Terms
We may update these Terms from time to time. We will post any changes on our website and update the “Last Updated Date” at the top of this document. Your continued use of our services after the posting of changes constitutes your acceptance of the updated Terms.
